Trackout, Inc. ("Trackout," "we," "us," or "our") operates the Trackout platform at trackout.ai and the Trackout mobile application (collectively, the "Service"). This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you use our Service.
1. Information We Collect
Account Information
When you create an account, we collect your name, email address, phone number, company name, and password. If you sign in through a third-party provider, we receive the profile information you authorize.
Company & Fleet Data
We collect information you provide about your company, trucks, drivers, job sites, projects, truck requests, scale tickets, and invoices. This data is necessary to deliver the core functionality of the Service.
Location Data
When drivers use the Trackout mobile app with location services enabled, we collect real-time GPS coordinates to provide live fleet tracking. Drivers may disable location sharing at any time through their device settings, though this may limit certain features.
Driver Location Data — Additional Detail
Because location data is among the most sensitive categories of personal information we process, and because real-time fleet tracking is a core function of the Service, we provide the following additional disclosures:
- Who can see location data: Fleet managers and dispatchers within your organization can view real-time driver locations. Contractors or client companies you work with may see job-site arrival and departure data, but do not have access to continuous GPS tracking.
- Location history retention: We retain historical GPS location data for 90 days following the completion of a job. After that period, location history is deleted unless you have requested extended retention for compliance or recordkeeping purposes.
- Driver notification: Drivers are notified within the mobile application that location tracking is active when the app is running in the foreground. Background tracking is disclosed at the time of app installation and during account setup.
- Driver controls: Drivers may disable location tracking at any time through their device settings or within the app. Disabling tracking will prevent fleet managers from viewing real-time location but will not affect other app functionality.
Payment Information
Payment processing is handled by Stripe. We do not store your credit card numbers or bank account details on our servers. Stripe's handling of your payment information is governed by the Stripe Privacy Policy.
Usage & Device Data
We automatically collect information about how you interact with the Service, including IP address, browser type, device identifiers, pages visited, and timestamps. We use this data to improve the Service and diagnose technical issues. We currently use the following analytics service providers who may independently collect usage data: [INSERT ANALYTICS PROVIDERS, e.g., Google Analytics, Mixpanel, Segment]. Each provider's data practices are governed by their own privacy policies.
2. How We Use Your Information
We use the information we collect to:
- Provide, operate, and maintain the Service
- Process transactions and send billing notifications
- Provide real-time fleet tracking and dispatch features
- Send push notifications, emails, and SMS related to your account and jobs (see Section 2A regarding SMS consent below)
- Respond to support requests and communicate with you
- Monitor usage patterns to improve and develop new features
- Detect, prevent, and address fraud or security issues
- Comply with legal obligations
2A. SMS Communications and TCPA Consent
By providing your mobile phone number and creating an account, you expressly consent to receive text messages (SMS) from Trackout related to your account, job status updates, dispatch notifications, and billing. Standard message and data rates may apply. Message frequency will vary based on account activity.
We do not send marketing or promotional text messages without separate express written consent. You may opt out of SMS communications at any time by replying STOP to any message or by updating your notification preferences in your account settings. 3. How We Share Your Information
We do not sell your personal information. We may share your information with:
- Service providers — Third parties that help us operate the Service, such as cloud hosting providers, payment processors (Stripe), email delivery services, and analytics tools. These providers only access data necessary to perform their services and are bound by confidentiality obligations.
- Within your organization — Other users in your company account may see data relevant to their role (e.g., fleet managers see driver locations; contractors see truck request status).
- Business partners — Contractors and truck companies that interact through the platform share limited information (company name, truck details, job-site information) as necessary to fulfill truck requests.
- Legal requirements — We may disclose information if required by law, subpoena, or legal process, or to protect the rights, property, or safety of Trackout, our users, or others.
3A. Business Customers and Data Processing
If you are a business customer using the Service on behalf of your organization, you are acting as a data controller with respect to your employees' and contractors' personal information, and Trackout acts as a data processor on your behalf. Upon request, we will execute a Data Processing Agreement (DPA) that governs our processing activities in accordance with applicable law. Please contact us at support@trackout.ai to request a DPA.
4. Data Retention
We retain your account and fleet data for as long as your account is active or as needed to provide the Service. When you delete your account, we will remove your personal information within 30 days, except where retention is required for legal, accounting, or legitimate business purposes. Driver GPS location history is retained for 90 days following job completion and then deleted unless extended retention has been requested. 5. Data Security
We implement industry-standard security measures to protect your data, including encryption in transit (TLS) and at rest, secure authentication, and regular security audits. However, no method of transmission or storage is 100% secure, and we cannot guarantee absolute security.
In the event of a data breach that affects your personal information, we will notify you in accordance with applicable state and federal breach notification laws. Depending on the jurisdiction, this notification will be provided within the timeframe required by law. Notification will be made via email to the address associated with your account and, where required, to applicable regulatory authorities.
6. Your Rights
Depending on your jurisdiction, you may have the right to:
- Access the personal information we hold about you
- Request correction of inaccurate data
- Request deletion of your data
- Object to or restrict certain processing activities
- Request a portable copy of your data
- Withdraw consent where processing is based on consent

6A. California Residents — CCPA/CPRA Rights
If you are a California resident, you have additional rights under the California Consumer Privacy Act (CCPA) as amended by the California Privacy Rights Act (CPRA):
- Right to Know: You may request disclosure of the categories and specific pieces of personal information we have collected about you, the sources of that information, our business or commercial purpose for collecting it, and the categories of third parties with whom we share it.
- Right to Delete: You may request deletion of personal information we have collected from you, subject to certain exceptions.
- Right to Correct: You may request correction of inaccurate personal information.
- Right to Opt Out of Sharing: Although we do not sell personal information, we may share certain data with analytics providers in ways that may constitute "sharing" under the CPRA. You may opt out of such sharing by contacting us at support@trackout.ai or by using a recognized opt-out preference signal (e.g., Global Privacy Control).
- Right of Non-Discrimination: We will not discriminate against you for exercising your CCPA/CPRA rights.

7. Cookies & Tracking
We use essential cookies to maintain your session and authentication state. We may also use analytics cookies to understand how users interact with the Service. You can control cookies through your browser settings.
8. Children's Privacy
The Service is not intended for individuals under the age of 18. We do not knowingly collect personal information from children. If we learn that we have collected data from a child, we will delete it promptly.
9. Changes to This Policy
We may update this Privacy Policy from time to time. We will notify you of material changes by email to the address associated with your account at least 30 days prior to the changes taking effect. We will also notify you of material changes by posting the updated policy on this page and updating the "Last updated" date. If material changes affect how we process data you have already provided, we may request your affirmative consent before the changes take effect. Your continued use of the Service after changes are posted constitutes acceptance of the revised policy.
10. Governing Law
This Privacy Policy is governed by the laws of the State of Utah, without regard to its conflict of law provisions. Any disputes arising under this Policy will be resolved in the state or federal courts located in Salt Lake County, Utah, and you consent to personal jurisdiction in such courts.
